Subdivision review lapses; state HAPO issues notice of violation and Hines refers matter to counsel

City Administrator Roxane Worley told the Hines Common Council that a developer-submitted subdivision application required an engineering review, planning review and a lagoon capacity analysis. Staff met with the developer to discuss identified deficiencies and sent a follow-up email asking how the developer wished to proceed. The developer did not respond before the city's 120-day review period expired.
Worley said the developer filed a complaint with the State HAPO office and HAPO has issued a notice of violation to the City. The city has forwarded the HAPO notice and the developer's complaint to legal counsel for review and to obtain legal guidance about moving forward with a land-use decision. Worley informed the council for awareness; the council did not act to overturn or finalize any land-use decision at the meeting.
Worley said lagoon capacity was among the identified deficiencies discussed with the developer. The council directed staff to follow legal counsel recommendations before taking further action on the subdivision application.
