Mobile council denies upzoning for 5101 Moffett Road, approves other zoning and grant measures

The Mobile City Council on July 21, 2026 voted to deny a requested upzoning of 5101 Moffett Road from B-2 to B-3, after neighbors and council members said the broader commercial zoning would be incompatible with surrounding single-family homes.
Councilmember, District 7 said the parcel—annexed in 1956 and developed in the 1960s—has been vacant for years and is the site of illegal dumping, but argued that an upzone to B-3 ‘‘would allow for automobile services and repair services’’ that are not appropriate for the neighborhood. The councilmember noted the planning commission unanimously recommended denial and asked colleagues to join in rejecting the rezoning.
Neighbor John Mitchell (resident) told the council he feared the site would become overcrowded with vehicles and that the applicant would not follow city ordinances; he urged the council to keep the property at its current B-2 designation. Representing the property owner, George Hart said the owner planned only 15–20 used-vehicle parking spaces and ‘‘very light work’’ such as battery checks, and argued redevelopment would clean up the blighted lot.
After debate the council moved to deny the 5101 Moffett Road rezoning; the motion carried and the action was recorded as denied.
Elsewhere on the agenda the council took these actions:
- Ordinance 64028 (rezoning multiple parcels including addresses on Spring Hill Avenue): passed on a recorded vote, tally reported as 5 yes, 2 no, 1 abstain. - Ordinance 64029 (Dauphin Island Parkway item as read): moved and approved by voice vote. - Ordinance 64031 (rezoning application for 5361 Moffett Road from R-1 to B-3): denied after discussion and voice vote.
The meeting also included a vote granting permanent easements to Alabama Power for underground service to Fire Station 19 and Japanese Gardens, and a motion authorizing the mayor to apply for and accept a Department of Homeland Security/FEMA Port Security Grant for FY26; both were approved by voice vote.
Public comment at the meeting included transportation- and tourism-focused testimony from Sue Saviak, who identified herself as a retired United Airlines employee and urged improvements to cruise terminal parking, Amtrak platform capacity, on-site restroom facilities and airport concessions. ‘‘Mobile Airport Authority charges the airlines very high fees,’’ Saviak said, arguing those fees lead carriers to favor nearby cities; she cited comparative passenger figures to illustrate the point.
The council also approved a number of consent items and purchase orders on the consent agenda, and clarified votes on several contested rezoning items before moving on to announcements and adjournment.
The council will return as scheduled next week for items laid over and for consideration of contracts and park improvements noted in District 7’s remarks.
