Attorney Lewis read the town code (Section 46-85) and asked the applicant (the record shows Commissioner Tolbert had filed as the applicant and did not participate) the standard criteria questions the commission considers when deciding variances. No members of the public commented and commissioners reported no ex parte communications.
Vice Mayor Storie moved to approve the variance and Commissioner Cain seconded. The motion passed by voice vote with four members voting yes and one recusal. The record shows the commission found the variance met the statutory criteria under town code as read into the record during the public hearing.
During the meeting Attorney Lewis also noted the county will conduct beach renourishment north and south of Belleair Shore and that a contractor had asked permission to bring equipment through private property; Lewis said the town cannot grant permission for private property and will notify the company.
