Planning board grants erosion and sediment control permit for 207 Dual Hollow Road; DEC wetland permit required before construction

The Dover Planning Board on July 6 granted a determination of significance and approved an erosion and sediment control permit and site plan for a channel‑stabilization project at 207 Dual Hollow Road, subject to specific conditions including DEC wetland permit approval prior to commencement.
Adam Pendleton of Design Engineering Solutions summarized the proposal: “It's located on a 45 acre site... The project proposes to stabilize the channel... We did make a submission to DEC for a freshwater wetland permit on May 27. I followed up with them recently ... They're still reviewing the application.” Pendleton said portions of the channel outside the regulated adjacent area will be relocated and portions inside the buffer will be regraded and stabilized in the same alignment.
Planning staff reviewed the environmental assessment and noted the parcel lies within the Dual Hollow Brook Critical Environmental Area (CEA) and that wetlands on and adjacent to the property had been delineated and validated by DEC staff. Staff said DEC permitting and mitigation measures would address potential impacts; staff also described tree‑removal timing taken to avoid adverse impacts on Indiana bat habitat, and noted the applicant left removed trees on the ground to avoid ground disturbance.
The board’s resolution granting the erosion and sediment control permit and site plan approval lists conditions the applicant must meet before construction: submission of a $1,000 inspection escrow for the town engineer, a $10,000 performance guarantee acceptable to the town attorney and town board, and obtaining freshwater‑wetlands permit approval from the New York State Department of Environmental Conservation with a copy to the planning board. The resolution further requires the applicant to coordinate any work near the existing culvert beneath Dual Hollow Road with the town highway department and for the planning board engineer to provide a written statement showing authorized work was completed per the approved permit before a certificate of compliance may issue.
The motion was moved and seconded and adopted by roll call; members recorded "Aye" and the resolution was adopted. The applicant affirmed they would not begin work until required DEC permitting is complete.
