Commission warns Subculture Coffee to meet parking and permitting requirements or face revocation of in‑lieu parking approval

City staff updated the Commission on Subculture Coffee's progress responding to orders from the March 31 meeting requiring the business to: (1) stripe its parking lot to city standards, (2) retain a design professional for a Level‑1 site plan, (3) enforce employee off‑site parking, and (4) secure an off‑site parking agreement or pay required in‑lieu fees. Staff reported that the business submitted some materials late in the 90‑day window, that at least one application had expired and needed re‑submission, and that entitlement documents received over the past weekend were incomplete and not yet reviewable.
A representative for Subculture, David Ware, said the original contractor allowed permits to lapse, the business engaged a new contractor and staff resubmissions are pending; he said some in‑lieu fee payments were made in installments and asked for flexibility while paperwork is completed. Commissioners expressed frustration with the pace of compliance, raised continuing neighborhood complaints and asked why in‑lieu fees had not been paid in full. Staff reiterated that in‑lieu payments are contractual and due, and the city has repeatedly sought collection.
The City Attorney advised the Commission that the city may revoke in‑lieu parking approvals if Subculture is in breach of the agreement, which would require the business to demonstrate 13 parking spaces on‑site or have an enforceable agreement for off‑site spaces before operating. Commissioners directed the city attorney's office to prepare a resolution memorializing factual findings and potential revocation so the matter can be placed on an August agenda; staff suggested affording the business a final, short period to achieve compliance before formal action.
The Commission agreed to return the issue to a future agenda with a drafted resolution and supporting findings. Staff and the business representative said they will continue to work on outstanding permit and escrow matters in the interim.
