"I'm asking you to be an official party in the docket," Tom said, explaining that party status or comprehensive comments would give Marbletown a voice in how variable rates and virtual power-plant rules are designed and could allow participating residents to receive compensation. He said participation would not obligate the town to purchase equipment and that he would prepare and defend the comments for the town.
Board members raised concerns about legal standing, the need for legal and staff review, and the possibility of follow-up obligations. One board member asked whether the town should wait to see the staff plan before authorizing submission; another asked how much the final submission might differ from comments circulated earlier. The board required that the town not commit funds for this effort at this time and asked Tom to circulate a final draft before submission.
After discussion, a motion authorizing Tom to act as the town’s agent to submit comments in PSC case number 230165, with explicit direction not to expend town funds at this time, was moved, seconded and approved by voice vote. Tom agreed to send the board a final draft and to wait for an additional signoff step if substantive edits were made before filing.
