Council sets public hearing for Commercial Point Village petition, approves emergency notice language

Councilmember Jay said the body was not approving the NCA at this meeting: "You are not voting for the NCA right now. You were just voting to allow us to set a public hearing." The resolution, numbered 25-2026 as amended, formally finds the petition sufficient and authorizes publication of the hearing notice.
Councilmember Dustin praised a memorandum from the city attorney’s office explaining the use of emergency language: "I think Adam did a great job on the memo," he said, adding that the memo "clearly spells out, justifies why the emergency language is needed to proffer the public process." Council discussion and legal counsel referenced Bricker & Braden as the firm providing economic development advice on the matter.
Members moved to waive additional readings of the resolution and then approved Resolution 25-2026 by roll call. The roll call recorded affirmative votes from Councilmembers Patricia, Jay, Zeke, Courtney and Dustin.
Councilmembers and staff emphasized that the emergency language applies only to allowing prompt publication of the hearing notice; the council will take separate action after the public hearing if it chooses to advance the NCA through readings without emergency language. The next procedural step is the published public hearing, followed by any future readings and votes tied to the petition.
The council scheduled the hearing and indicated it will follow the published notice and normal public-comment procedures at that hearing.
