Planning board approves 12 Scofield Place farm stand with conditions; applicant must update site plan
Summary
The Planning Board approved an after‑the‑fact farm‑stand site plan at 12 Scofield Place (map 1, lot 5) on condition that the applicant add the farm‑stand location to the 2004 site plan, confirm setback measurements, and record the notice of decision; the motion passed 4–1.

The Harpswell Planning Board reviewed a site‑plan application for a new farm stand on a 25‑acre property (partly in Harpswell) owned by Linda Lee Barton with an applicant who identified himself at the hearing. Planner Margaret McIntyre reported the stand was already built and that the completeness review (dated 07/16/2026) recommended six submission waivers for items such as deed covenants, stormwater and nearest fire‑hydrant details. The board voted to accept the application as meeting submission requirements subject to those waivers.
Board members examined setbacks, parking and utilities. The applicant stated the stand uses rooftop solar power and has no hardwired electric or plumbing; the planner and members asked that this utility information be added to the revised application to keep records accurate. Members asked the applicant to place the farm‑stand location on the existing 2004 site plan for Nancy’s Seafood Shanty (now the adjoining takeout business) so setbacks and parking can be confirmed visually against the earlier approval.
Debbie Forrester voiced concerns about missing accurate scaled maps and the application text; other members proposed approving the application conditioned on the applicant providing a revised plan that shows the farm‑stand location and confirms that all required setbacks are met. The board accepted findings of fact (with additions to fill in measured setbacks) and concluded the application meets the site‑plan review standards, approving the farm stand with conditions by a 4–1 roll call (Debbie Forrester opposed).
Conditions include: adding the farm‑stand location and measured setbacks to the 2004 approved site plan (showing compliance with applicable setbacks), recording a copy of the notice of decision at the Cumberland County Registry of Deeds within 45 days, and ensuring permeability/lot‑coverage details are reconciled. The approval is not final until the chair signs the final plan showing the conditions and any required waivers.
What’s next: the applicant will add the farm‑stand location to the referenced 2004 site plan, clarify utilities in the application record (noting rooftop solar), and submit final plans for the chair to sign and for recording.
