PZHAC approves five local cases, discusses access to 3100 Snow Road

The Planning, Zoning and Historical Appropriateness Commission approved five local items at its Oct. 20 meeting and held a nonvoting discussion regarding legal access for a property on Snow Road.

Discussion — 3100 Snow Road access Staff presented a request from Greg and Jennifer Gifford to confirm whether their parcel on Snow Road has legal vehicular access via DiMatteo Road. CED Eddie Salazar summarized two statutory pathways: a prescriptive easement under NMSA 47-12-3 (open, notorious, continuous use, commonly a 10-year period) and an easement by necessity under NMSA 47-1-4 for landlocked parcels. Salazar recommended confirming the physical easement and coordinate with New Mexico EBID (because a drain crosses the route) and the county before accepting legal access for subdivision/site approvals.
Commissioners' comments and follow-up Commissioners praised recent trainings staff attended and discussed topics the town should consider updating in its ordinances — food trucks, temporary RV/tiny-home parks, nuisance abatement, hearing officers and potential squatters ordinance. Staff said it will follow up with county agencies and NM EBID on the Snow Road access question and will prepare any materials required for Board of Trustees review on cases that need final approval.
The PZHAC adjourned after reading posting and ADA accommodation notices.
