Mexico Beach council approves termination of obsolete Gulf Air wastewater easement

Mexico Beach — The City Council voted Oct. 28 to approve termination of a utility easement that previously allowed wastewater from Gulf Air Subdivision to be processed through Mexico Beach systems.
Staff told the council the small wastewater treatment plant that gave rise to the easement no longer exists and the underlying property has been sold; the easement remains on the title. City staff recommended the council authorize the city to coordinate termination negotiations and require the requester to pay any related expenses because the city had little involvement in the original arrangement.
A council member moved to approve termination of the easement; the motion was seconded and carried on a council vote. Council also noted the city attorney had recused himself from the discussion because he had previously represented some parties in the transaction.
The council directed staff to proceed with coordination and negotiation consistent with the requester-bearing-cost recommendation. The termination is procedural and will require coordination of deed/legal instruments as part of the property transaction.
