Diane Brown told the City Council on Oct. 7 that her 77‑year‑old father, Leon Brown, received a citation after placing a trailer on his property at 311 South Fleming Street and asked the council to act so he could continue using his property.
"He received the trailer as of today for 10 months," Brown said, and she told the council the citation was issued on Aug. 26, 2025. She said her father followed the city's approval steps and that a city employee, Shane Davis, had told them the placement was acceptable. "He told me he was gonna give him his money back," Brown said, describing a failed promise of a refund she says she later verified did not occur.
Mayor (speaker 1) and other council members cautioned that the citation is scheduled for adjudication in municipal court and that the city must respect separation‑of‑powers constraints. "Once it's adjudicated, we're basically hands off," the mayor said, adding the council could reconsider action after the court process if appropriate.
Another member recommended letting the judicial process run its course and then, if necessary, the council could revisit the matter. The council recorded no formal motion to overturn the citation; staff advised that any direct intervention before adjudication risks violating state guidance about separation of powers.
The council did not take formal action at the meeting; the record shows the citation is on the court docket for the following day at 1:30 p.m.
