Valerie Bollinger, Administrator of the Division of Purchasing at the Department of Administration, told the Senate State Affairs Committee that a pending rule rewrite (Docket No. 38-0501-2401) is guided by three objectives: remove the Invitation to Negotiate (ITN) process from the rule, ensure the rule is grounded in statutory authority, and clarify language and organization for consistency.
Bollinger said Subsection 042.05 adds specific parameters for exempt purchases to ensure exemptions align with legislative intent about competition, Sections 071–074 remove bid-opening language to match statute, and Section 083 deletes solicitation restrictions tied to ITNs. She said references to ITNs were removed throughout the draft rule.
Senator Den Hartog asked about the history of ITNs being incorporated into the rule; Bollinger said the history was unknown. Senator Den Hartog moved to approve the docket; Senator Harris seconded the motion and it carried by voice vote. The minutes record the committee’s approval of the pending rule rewrite; the action moves the rule forward as described in the docket.
