ACC approves 2025 Annual Compliance Report; trustee dissents over ADA‑accessibility uncertainty

The Audit and Compliance Committee approved Florida Gulf Coast University’s 2025 Annual Compliance Report on April 7, 2026, following discussion about reporting trends and accessibility requirements. Precious Gunter, Chief Ethics and Compliance Officer and Title IX Coordinator, summarized the report, saying the number of cases reported had increased but that she attributed the rise largely to greater awareness generated by training, outreach and hotlines. She said the majority of cases involved student matters and noted that Title IX case counts were similar to prior years and somewhat lower than State University System peer institutions.
"FGCU had consistently seen an increase in the number of cases reported; however, I believe that was linked to awareness," Gunter said. Trustees asked for additional historical and peer comparisons to provide context for the figures presented on page 29 of the report.
Trustee Derek Lura raised questions about whether the report and archive materials met new Americans with Disabilities Act (ADA) digital accessibility requirements. Vice President and General Counsel Kristi Carman said archival documents would include a website statement directing users to request accessible versions and reiterated that the ADA law was effective April 24, 2026. Chair Joseph Fogg said he would schedule a follow‑up meeting with Gunter and Carman to ensure Board materials meet accessibility obligations.
Trustee Doug VanOort moved to approve the 2025 Annual Compliance Report; Trustee Henry Saad seconded. The Committee approved the report by voice vote, 3–1, with Trustee Derek Lura recording the dissent. The Committee will recommend the report to the full Board on April 14, 2026.
