Kylie Simons asked the council on June 16 to grant city water to her property outside Boulder city limits because her well was failing; she said she did not want to annex. City Administrator Brian Bullock told the council state law permits a city to provide water to properties outside city limits. Planning Board President LaDana Hintz pointed to the city's Annexation Policy (Resolution 2022‑10), which she said prohibits providing water to people who do not annex.
Mayor Russell Giulio suggested tabling the discussion and consulting City Attorney Ed Guza for legal advice. The council tabled the matter with direction to seek counsel and make a future determination. No service agreement was approved at the meeting.
