Council backs quicker towing and impound process to address junk vehicles

Cresco City Council signaled support for a more-direct tow-and-impound approach to enforce the city's junk-vehicle ordinance and to reduce the backlog of long-standing nuisance vehicles.

Public works described options in the draft ordinance: give property owners 15 days to remediate, then either arrange impound via towing companies or pursue a municipal-infraction court process. Public works said the court-driven route can cost the city roughly $500–$1,000 in attorney and magistrate time. "That particular process cost about $500 in attorney fees to do it that way," public works said. Public works and the police described a commonly used abandoned-vehicle procedure: if a vehicle is impounded by order of police and not reclaimed for 10 days, it may be declared abandoned and processed accordingly. The police chief confirmed the department will carry out towing/impound steps where appropriate.

Several council members urged adding enforcement "teeth" so repeated nuisances are addressed rather than cycling through lengthy warning periods. The Chair observed that repeated nonresponse should be treated as an actionable response: "No response is a response though," the Chair said. Council discussion emphasized balancing enforcement with legitimate restoration projects for hobbyists, but the group expressed a shared preference to prioritize streamlined enforcement rather than costly court proceedings.

Council did not adopt a final, amended ordinance on the record during the meeting; instead, members directed staff and police to proceed with the impound/tow and abandoned-vehicle process and to coordinate steps with legal counsel and towing vendors.
