Council reviews Eons Preserve memorandum to clarify nonprofit donations and city responsibilities

City staff presented a memorandum of understanding intended to formalize the relationship between the City of Erlanger and Eons Preserve Inc., the nonprofit intended to accept easements and facilitate donations for a valley‑preserve and park amenities.

Staff said the memorandum would clarify that donations placed on city property become city property and could therefore create maintenance obligations for the city; donations intended for the preserve could include funds earmarked for maintenance, and staff discussed the need to ensure compliance with bidding and procurement rules where municipal work is involved. The memorandum is intended to be adopted by municipal order at an upcoming meeting, and staff noted that additional municipal orders or resolutions would be brought to council as specific projects, donations, or maintenance agreements arise.

Council members asked whether the preserve could build on private or nonprofit land and whether the city would have responsibility for maintenance or emergency responses if amenities are off city property but within Erlanger limits. Staff said arrangements would vary depending on land ownership: amenities on city property would become city assets; amenities on privately donated land or outside municipal ownership would be maintained by the nonprofit or subject to separate agreements. The memorandum is an initial, "living" document, and staff said additional details will come back to council as specific projects advance.
