"There’s been 6 lots coming up for sale on Pine Point Road," the participant said during the mail-and-correspondence portion of the meeting. Board members reviewed lot numbers as transcribed and discussed possible permitting paths, including whether owners on private roads could obtain building permits by signing a liability waiver.
One participant cited RSA 674:41, saying that under that statute a municipality cannot refuse to issue building permits on certain private roads if owners sign a waiver of municipal liability and show structures are insurable. Board members responded that local woodlot protections in New Durham could continue to restrict development even when a waiver is in place.
Members asked staff to monitor the Pine Point listings and flag any applications that would require waivers or woodlot exceptions; no formal application or hearing on those lots occurred during the meeting.
