Estacada council authorizes tender and completion contracts for Eagle Creek pump station; adopts supplemental budget and amends parks code

At its regular meeting, the Estacada City Council moved through several formal actions: it adopted a supplemental budget resolution, authorized a tender agreement with the insurer handling a performance bond claim, awarded a completion contract to finish the Eagle Creek pump station, approved a driveway-width variance on Park Avenue, and adopted an ordinance amending Chapter 2.20 to rename and clarify duties for the parks commission.

City attorney Laura Westmeyer explained the Eagle Creek pump station contractor had defaulted and the city called the contractor's performance bond. The bond insurer offered a completion contractor and a tender agreement that would close the insurer's claim in exchange for a lump-sum payment for liquidated damages (identified in staff briefing as about $54,543). Westmeyer said the insurer also will provide a completion contractor; staff presented an evaluation and recommended awarding the work to Werdinger Excavating.

A councilor moved to authorize the city manager, in consultation with city engineer and city attorney, to negotiate and execute a tender agreement with the insurer on the terms discussed; the motion passed on roll call. The council then authorized the city manager to negotiate and execute a completion contract with Werdinger Excavating Incorporated to finish the Eagle Creek pump station; that motion also passed on roll call.

Separately, the council opened a public hearing on Resolution 2026-001, a supplemental budget and appropriation for fiscal year 2025–2026, received no public testimony, and adopted the resolution by motion and voice vote. The council also approved a driveway-width variance for Lots 34 and 35 in the Lock Martin Subdivision on NW Park Avenue after staff reported no negative neighborhood impacts. Finally, councilors discussed and adopted an ordinance amending the municipal code to change the Park and Recreation Commission's name to the Recreation and Activity Commission and to broaden its duties (advocating for outdoor activities, hosting one certified race annually and one fun run, and providing year-round programming).
