Drainage board approves Lebanon MOU and multiple development and tile-vacation requests

The Boone County Drainage Board approved several interrelated drainage and development actions that will allow local projects to proceed to bidding and construction.
Surveyor’s staff presented an intergovernmental MOU with the City of Lebanon for reconstruction of the Price legal drain — a 48-inch tile under State Road 39 and the CSX Railroad intended to provide drainage for roughly 1,000 acres on the east side of SR 39. Surveyor staff said the City of Lebanon would be responsible for reconstruction costs; at project completion the reconstructed tile would become part of the legal drain system and be maintained by the Boone County Drainage Board.
The board also considered Peabody Farms East Section 4, a phase of a larger residential development. Terry Daley of Christopher Burke Engineering told the board the section will provide about 79 lots on 19.5 acres and includes one additional detention basin; engineers and the surveyor's office recommended final approval subject to the surveyor’s office final review.
As part of the Peabody East approvals, the board accepted a petition to vacate the upper portion of the Walker legal tile and its easements, saying the development’s engineered storm-sewer system will replace that tile’s function. The surveyor noted the vacated tile will not affect upstream properties. The board similarly approved a petition to vacate the upper end of the LEAP and LEAP tributary 1 tiles for the Indianapolis Logistics Park Northwest Phase 2 project, which includes infrastructure and floodplain compensation areas.
Why it matters: These approvals clear obstacles for private development and municipal reconstruction projects in Boone County, shifting responsibility for certain drainage features to new public infrastructure and allowing contractors to proceed to bid and construction.
Next steps: The MOU with Lebanon will advance the city’s bidding process; developers will finalize plan revisions with the surveyor’s office before recording and construction. The surveyor’s office will return signed vacation documentation to the board at a later meeting.
