Torrington approves $42,780 amendment for East D Street inspection; contractor faces potential liquidated damages

The Torrington City Council approved Amendment No.1 to the professional services agreement with M.C. Schaff and Associates for $42,780 to cover additional construction administration and inspection on the East D Street Improvements Project.
Director of Public Works Harkins said the project was suspended for winter on Dec. 23, 2025 and restarted March 2, 2026, and that three change orders have added 48 calendar days to the contract. The amendment covers inspection and engineering costs associated with the extended duration; Harkins told the council the City has $7,000,000 available for the project and that, even with the amendment and change orders, the project remains within budget.
Don Dye of M.C. Schaff and Associates addressed the council and confirmed a substantial completion date of July 31, 2026 in city documents but said the contractor's updated schedule (Change Order No. 3) anticipates completion by Aug. 15, 2026. Dye noted that "any days after 07-31-26 would be subject to liquidated damages." Councilman Viktorin moved and Councilman Deahl seconded approval of Amendment No.1; the motion carried unanimously.
The amendment funds additional inspection and engineering work tied to schedule extensions; the council record notes follow-up as part of project oversight and adherence to contract terms and liquidated damages provisions if the contractor exceeds the stated substantial completion date.
