Parole board orders correction to 2011 action sheet, directs Bureau to notify DOC to recalculate 'deadtime'

At its Aug. 27, 2025 meeting the Alabama Board of Pardons and Paroles reviewed a request from parolee Timothy Paul Smith (AIS# 212317) concerning a 2011 Board Action sheet that recorded him as "re-instated" rather than "continued on parole." The board said the hearing officer in 2011 found insufficient evidence of a violation and recommended that the parolee be continued on parole. Because the 2011 action sheet reflected reinstatement, Mr. Smith was charged with "deadtime" from Feb. 28, 2011, through Aug. 2, 2011, the minutes state.

The board determined it lacked authority to "reinstate parole" in the circumstances described by the hearing officer's finding and therefore ordered the 08/02/2011 Board Action sheet amended to reflect that Mr. Smith was "continued on parole." The Board also directed the Bureau of Pardons and Paroles to notify the Alabama Department of Corrections and to recommend that DOC recalculate Mr. Smith's sentence time so the recorded "deadtime" is removed.

Board members Hal Nash (chair), Darryl Littleton and Gabrelle Simmons are recorded as approving the order. The minutes show the Board considered the technical legal distinction between "continued on parole" (which does not create deadtime) and "reinstated to parole" (which can create deadtime if a violation is proved). The minutes do not record further DOC action; the Bureau was assigned to notify DOC and recommend recalculation.
