Eric, speaking for staff, read the public notice that the meeting was being broadcast via video teleconference and Facebook and that a public viewing location was available at the Kentucky Public Pensions Authority offices at 1260 Louisville Road in Frankfort. He also instructed participants to identify themselves if they were not on video and said that if a connection could not be reestablished within 30 minutes the meeting would be adjourned and rescheduled.
Sherry took roll. Members called and recorded as present during roll call included Mister Cheatham; Dr. Carver; Mister Foster; Dr. Hackbarth; Mister McGraw; Mister O'Meara; and Mister Webb, according to the roll-call prompts and affirmative responses recorded on the call.
At the open session the chair said, “At this time, I'd like to, entertain a motion to go into closed session in order to discuss legal issues pursuant to KRS 61.810(1)(c).” Eric moved the motion; one or more members seconded. The chair called for the ayes, members answered “aye,” and the chair announced, “Ayes have it,” approving the motion to move into closed session.
The chair then stated that a motion had been made and voted on by a majority of the board in open session to go into closed session pursuant to KRS 61.810(1)(c), and declared the meeting in executive session to discuss pending or proposed legal issues. Staff were instructed to remove the public broadcast and transition the meeting into the executive/closed portion.
No substantive legal discussion or decisions on the merits were recorded in the open session. The board moved into executive session as the next step; no additional votes or outcomes were announced in the open portion of the meeting.
