Fulshear adopts permit requirement, fines for donation boxes

The Fulshear City Council on Jan. 6 approved an ordinance to regulate donation boxes on private property, requiring a permit, property-owner authorization and placement limits designed to prevent safety or sightline impacts.
A city staff member told the council the ordinance would require operators to obtain a permit and permission from the property owner and would regulate where boxes could be placed in parking areas so they do not impede traffic. "It's pretty straightforward," the staff member said, noting the ordinance also authorizes the city to remove a box that creates a nuisance or results in illegal dumping.
Councilmembers asked whether existing donation boxes would be grandfathered and if advertising could appear on boxes. Staff said existing boxes might be grandfathered for permitting but would still be subject to code enforcement if they became nuisances; advertising concerns could be addressed through the city's sign ordinance. Staff also said permitting fees will be added to the master fee schedule and that enforcement will be handled on a case-by-case basis with leniency where appropriate.
The ordinance sets penalties for violations not to exceed $2,000. Council passed the ordinance by voice vote after discussion.
