The Brewer City Council unanimously certified and filed five proposed Land Use Code amendments at its June 23 special meeting.
Councilor Michele LaBree Daniels presented ORDINANCE 2026-C013 to amend Article 4 (Performance Standards), which includes revisions to off-street parking rules (allowing off-site parking within defined distances and permitting off-site employee parking with an approved shuttle service under conditions), exemptions for the Downtown Development District, updates to residential parking calculations, short-term rental use restrictions, and detailed design, operation, maintenance and inspection standards for electric vehicle charging stations (EVCS) including fire-blanket placement, surge and lightning protection, bollards, signage and routine inspection requirements.
Councilor Dani O’Halloran presented ORDINANCE 2026-C014 to tighten the Certificate of Occupancy process in Article 6 by requiring completion of site improvements for each phase before issuance, and by clarifying when a Certificate of Compliance stamped by a licensed professional is required.
Councilor William Kimball presented ORDINANCE 2026-C015, a comprehensive set of revisions to Article 10 (Mobile Home Parks). The amendments add explicit licensing requirements, application and plan submission standards, minimum lot sizes and setbacks, street and walkway standards, parking and guest‑parking ratios, water and sewage requirements, open-space and recreation provisions, tenant registration and records requirements, and enforcement language including license revocation. The text references compliance with State laws such as shoreland zoning and federal manufactured housing standards where applicable.
Councilor Soubanh Phanthay filed ORDINANCE 2026-C016 to update Article 14 (Definitions), clarifying terms including manufactured housing/manufactured home parks and defining “Off‑Site Parking Facility.” Councilor Michele LaBree Daniels filed ORDINANCE 2026-C017 to repeal Chapter 25 (Mobile Home Park and Camping Park Ordinance) as redundant or conflicting with the revised Chapter 24; the order directs the City Clerk to update city code references accordingly.
The ordinance materials state the Brewer Planning Board held a public hearing on June 8, 2026, and issued unanimous favorable recommendations for these amendments; the orders note there were no public comments. ACTION: Councilor Daniels moved that the amendments on the consent calendar be certified and filed with the City Clerk for posting; Councilor Phanthay seconded and the motion passed unanimously.
The amendments are substantive for land‑use administration: the mobile home park revisions impose new site planning, infrastructure, and operational standards; the EVCS provisions add new safety and maintenance requirements that applicants will need to meet; the parking language creates mechanisms for off-site parking and shuttle plans when on-site parking is infeasible.
