Fenton board opens Aquifer Development Permit hearing for 36 Nowlan Road and continues review to July 28

The Town of Fenton Planning Board opened a public hearing June 30 on an Aquifer Development Permit application from Phoenix Binghamton Industrial Investors for proposed loading docks and a truck ramp at 36 Nowlan Road and temporarily closed the hearing the same night after receiving no public comment.

Chairperson Christa Kark explained that the public hearing is limited to the Aquifer Development Permit under Chapter 57 (Aquifer Protection) of the Town Code and reviewed public-comment procedures. Assistant Project Manager Ben Cooke described the scope of work: excavation of the northwest section of the building, construction of a concrete truck ramp, underpinning and retaining walls, installation of two loading docks on the currently vacant half of the building, reworking the fence to add a sliding gate, and paving a small portion of the parking lot to accommodate heavy trucks. Cooke said the aim is to make the vacant half truck-accessible and attractive to future tenants; Elliott Manufacturing currently occupies the other half and has existing loading docks.

Because Broome County's 239 review had not been completed, the board declined to undertake a full review at the June 30 meeting and scheduled the application and the Aquifer Development Permit public hearing to resume at the Planning Board meeting on July 28, 2026. The board reiterated that members of the public wishing to comment must state their name and address and are limited to three minutes when the hearing reopens.
