On March 30, 2026, the Fairway Planning Commission recommended that the governing body approve a special‑use permit for a private sports court at 5766 Windsor Circle, granting exceptions to the green‑space requirement and to the watershed analysis requirement and subjecting the recommendation to staff conditions and payment of fees or penalties.
Staff reported receiving four letters of support for the application and said that although staff was not supportive of granting the green‑space exception, it would record the recommendation and outline required fees and conditions. "We did receive 4 emails and letters in support... staff is not opposed to the special use permit. And, again, we're not supportive of the green space," Basil said.
Applicants Anna and Donald Friend told the commission the court was installed in 2018 while they were remodeling the house and that they believed prior inspections covered the work; they offered to pay any required penalties. "We put this sport court in in 2018 when we got a building permit to remodel our house thinking that we were doing everything correct," Anna Friend said, adding that a professional contractor installed the court. The applicant's engineer calculated green‑space near 69.9 percent, but staff and commissioners discussed how Fairway’s rules treat very large lots and how percentages are computed.
The commission voted to recommend approval and to grant the green‑space and watershed exceptions, citing neighbor support and the large lot size; the recommendation will go to the governing body for final action and is conditioned on payment of permit and penalty fees where required.
