Council sets Dec. 8 hearing on proposed 53rd Street Community Improvement District

On Nov. 10, 2025, the Fairway City Council approved resolution 20-25h to set a public hearing on Dec. 8 regarding the advisability of creating the 53rd Street Community Improvement District (CID) covering the former Houlihan's parcel.
City administrator Nathan explained the city had received a petition from the property owner—the first statutorily required step—and that the resolution simply schedules the hearing; it does not commit the city to create the CID or to any financial terms. Nathan said the development agreement, which staff is negotiating and hopes to bring to the Dec. 8 meeting, will define the CID's terms, any additional sales tax (statute allows up to 2%), timelines, caps and contingencies.
Nathan said developers frequently request a pay-as-you-go financing structure where the city collects an additional sales tax within the district and remits a portion to the developer under the development agreement. Nathan said the public hearing could proceed even if the development agreement is not ready; council action could condition approval of the district on a later agreement. Councilmembers expressed optimism the petition would allow the process to move forward and thanked staff for persistence in negotiating outstanding issues.
A motion to approve resolution 20-25h was moved and seconded; the council approved setting the public hearing by unanimous voice vote. Nathan advised the council to be prepared for a possible executive session and a special meeting depending on timing for the development agreement.
