The North Canton City Council approved a variance to allow a detached garage to be placed 2 feet from the rear and 2 feet from the side property lines at 212 Donner Avenue (Application VBLA26-11), finding lot shape and access needs justified the reduced setbacks.
Bruce Connery of Buckeye Cervantes Services, representing the property owners Aaron and Mike Gilpin, said the existing garage was in very poor condition and the lot is shallower than others on the block. Connery described a proposed pre-engineered metal garage, 18 feet wide by 20 feet deep, and said the layout would allow vehicle access without trespassing on neighbors if the reduced setbacks were approved.
An adjacent neighbor, Ralph Larson of 224 Donner, objected and said he and his wife have lived on the block 51 years and fear large trucks and concrete mixers will traverse and damage their property. Larson requested written assurances that contractors would not use his yard for staging and would repair any damage.
Staff and the applicant said a pre-engineered building delivered in sections requires less on-site framing and that Stark County GIS indicates sufficient room to complete work without encroachment. The board discussed mitigation such as marking property lines, asking for use of a line pump for concrete to avoid tailgating trucks, and placing a formal condition on approval. The chair moved to approve the variance with the condition that all work, equipment and staging remain on the property at 212 Donner Avenue NW; roll call indicated assent from members present and the variance was approved with those conditions.
The record shows the applicant offered to mark the property line and staff suggested a condition requiring on-site work only; the board included that condition in the approval.
