Council tables developer’s request to upgrade water main pending easement research

Developer Mckay Cordner asked the council Dec. 9 for permission to upgrade a 6-inch water main to a 12-inch line through the Hardcastle family property, saying he could not find a written easement. Cordner requested six residential connections and a valve at the top of the hollow for future development connections.
City Attorney Lyle Fuller advised the council that not having a written easement is not uncommon and that the city likely has an implied easement for access to repair and maintain the water line; Cordner’s proposed upgrade would be included in that easement. After discussion, the council voted to table the matter for 30 days to research the written easement and the city’s options.
The item will return to the council after staff research; no approval to construct the upgrade was granted at the meeting.
