Burley council adopts 2026 fee schedule, approves three annexations and related easements

The Burley City Council on June 2 adopted a new Master Fee Schedule and approved three separate annexations after brief presentations and routine votes.

City Clerk Elois Joseph-Pieterse presented the canvassed results from Cassia County for the May 19 election before the council moved on to business. "Cassia County canvass results for the May 19, 2026 election have arrived," she said; the council voted 6-0 to accept the canvassed certified results.

The council then considered a public hearing and a resolution to adopt a new fee schedule. P&Z Administrator Spencer McArthur said the fee schedule had been posted for public review and would be placed on the city website. No members of the public spoke during the hearing. Councilmember Jim Powell moved to adopt Resolution 11-26, which the council approved by roll call vote 6-0.

Annexations and zoning P&Z Administrator Spencer McArthur presented three annexation items, each approved after the council dispensed with multiple readings and allowed a single-title reading.

Ordinance 1438 would annex Cassia County Tax Parcel RP10S23E283861 (2020 Bennett Avenue) and initially zone it R-2A, a designation discussed as allowing special use permits for certain office-related uses. Councilmember Jim Powell declared a contractual interest in that property and recused himself from deliberations and voting. The motion to adopt Ordinance 1438 carried 5-0 with one recusal.

Council also approved acceptance of public right-of-way and utility easements related to the Bennett Avenue parcel. McArthur said the city will hold easements to allow future water service and right-of-way access but will not be required to maintain the existing private road; that easement acceptance passed 5-0 with Powell recused.

Ordinance 1439 would annex Cassia County Tax Parcel RP10S23E320990 (2975 Overland Avenue) and initially zone it C-2. McArthur said the property owner requested annexation because of a failing septic system; surrounding parcels were already C-2. After a brief discussion and a single-title reading the council passed Ordinance 1439 by a 6-0 vote.

Ordinance 1440 concerned annexing a portion of Minidoka County Tax Parcel RP10S23E078000 (approximate address 368 S 750 W, Heyburn) for enclosed manufacturing and an initial C-2 zoning designation. Alan Clawson, representing Yankum Ropes, addressed the council, saying the company planned to perform all operations inside the building and that it expects roughly one semi-truck per day plus UPS deliveries for a 2,500-square-foot facility. Clawson said Yankum Ropes would complete required dust-abatement measures and thanked city staff for help with the process. The council approved Ordinance 1440 by voice/roll-call vote 6-0 after a single-title reading.

Appointments and other business Mayor Steve Ormond presented a recommendation from BDA Administrator Mark Mitton to appoint Brooks Corbridge to the Burley Development Authority for a three-year term ending January 2029; the council approved the appointment 6-0.

The council also read and supported a proclamation for "Support Local Gems Day," and staff provided routine project and event updates. City Administrator Brett Boyer noted upcoming events including an AIC conference and a July 4 celebration; Engineer Dave Waldron described a Parke Avenue sinkhole and ongoing repair work, while Bryan Reiter updated on paving and bridge timelines for Overland/Main.

Public safety Deputy Fire Chief Casey Harman reported an active wildfire at approximately 62% containment, burning 1,743 acres with no structures currently threatened.

The tabled Ordinance 1437 (garbage-collection code amendments) will return to a future meeting. The council adjourned at approximately 7:59 p.m.
