The Arundel Planning Board on July 21 approved a site-plan application by L and R Family Holdings LLC for a two‑phase commercial development at 2365 Portland Road.
Acting Chair Paul Green opened the public hearing at 7:03 p.m. and described the proposal as four commercial buildings (Buildings A–D) totaling 22 units with 99 parking spaces and a new access road on a 7.95‑acre parcel in the BI (business/industrial) zone. "This project will have two phases," Green said as he read the application summary.
Nicole Sanborn of Tidewater Engineering and Surveying, the applicant's agent, told the board the development will include three stormwater basins, public water from Portland Road, and separate disposal systems for Buildings A–B and C–D. "We are here tonight seeking site plan approval to construct a commercial development at 2365 Portland Road in Arundel," Sanborn said. She also said the owner was present in the audience (the transcript spells the owner’s last name variously).
Town Planner Natasha Kipper summarized staff findings and conditions and noted the applicant’s site-work estimate, which the staff used to calculate a proposed performance assurance amount of $1,740,000. "I did craft a suggested motion and suggested conditions," Kipper said, naming the performance assurance and other standard pre‑permit requirements.
Board members pressed for clarity on phasing and stormwater infrastructure. The applicant confirmed that the third stormwater basin will be built with phase 2 because it collects runoff tied to Buildings C and D; basin 1 and basin 2 will be constructed with phase 1. The board agreed to define "substantial completion" under the land-use ordinance as completion of phase 1 (Buildings A and B) together with the associated parking, utilities and phase‑1 stormwater infrastructure.
A board member moved to approve the application with the staff‑recommended conditions and waivers. The board also debated whether the one‑year clock to commence construction and the two‑year clock to achieve substantial completion should begin on the date of approval or on the date the applicant receives required state and federal permits. The board approved an amendment specifying that those timing periods will commence upon the applicant's receipt of all required permits, citing delays in state and federal review.
The board voted to waive four impact studies outlined in paragraph 10.5.0.2.07 of the Arundel Land Use Ordinance—the fiscal impact assessment, the traffic impact assessment, the groundwater study and the market study—and approved items 1 through 10 in the staff motion. The approval is subject to conditions that include filing a fully executed performance assurance pursuant to sections 10.71 and 10.72 before any building permit is issued and submitting evidence of issuance of all required state and federal permits prior to land‑disturbing activities.
The board and applicant agreed the applicant will provide updated final plans with the approved conditions noted; once the plans are finalized they will be signed at the planning office. The board adjourned at 7:43 p.m.
