Councilor Roby moved the committee recommendation to approve the modification; the council conducted a roll-call vote and the motion passed with nine members voting in favor, one opposed and one absent. Councilor Preciado voted no; one member was recorded as absent.
The decision includes explicit procedural directions: the applicant, at its expense, must record the special permit after the appeal period has lapsed and provide copies of the recorded permit to the city council office, the building department and the city solicitor’s office before applying for a building permit. The council noted the planning board’s related variance requirement and reiterated that all other conditions of the original special permit remain in force.
After the vote the council president observed that, based on the night’s votes, no special meeting would be required on Wednesday.
