Fishers BZA approves reduced setbacks for Loma Court Lot 7 to allow new industrial building

The Fishers Board of Zoning Appeals approved two variances on July 22 that reduce the front setback from 100 to 90 feet and the rear setback from 50 to 20 feet for Lot 7 at 7727 Loma Court to permit construction of a new industrial building.
Jack Witsett of Church Church Hittle & Antrim, representing applicant John Gallagher, told the board the lot is the last undeveloped parcel in the Loma Court Industrial Park and that the requested setbacks respond to the property's configuration and proximity to the Nickel Plate Trail. "We request these setbacks as it's implicated by the property's unique layout, being right up next to the Nickel Plate Trail," Witsett said.
Grace Wiley, senior planner for the City of Fishers, summarized the staff report, saying the property is zoned I-1 (industrial), is designated in the comprehensive plan as a flex employment center/R&D area, and that no public comments were received. Staff offered no recommendation for approval or denial but recommended, should the board approve, that the approval and related documentation be recorded with the Hamilton County Recorder's Office.
No members of the public spoke on the petition. A board member moved to approve VA-26-7 with the recording condition; the motion was seconded and passed.
The approval allows the applicant to proceed toward site development subject to the recorded condition.
