Box Elder board approves lot-frontage variance for East Mall Court property

The City of Box Elder Board of Adjustment voted unanimously July 29 to approve variance 240231489, allowing a lot frontage of 96.12 feet at 489 East Mall Court to permit a boundary-line adjustment and accommodate parking and internal traffic circulation for the adjacent developed property.

Michelle Clavadach, planner with the City of Box Elder, presented the staff report and told the board the parcel’s irregular shape and the street design — an abbreviated bulb-shaped cul-de-sac — affect lot frontage measurements. "So this application involves a request for a variance to allow a lot frontage of 96.12 feet at 489 East Mall Court," Clavadach said, and described the lot as proposed Lot F1 of RDO Subdivision. She reviewed the five variance criteria in section 44-6-38 of the Box Elder municipal code and said staff found the request meets items a through e.

Clavadach said the boundary-line adjustment is intended to shift the lot line to better serve parking and internal traffic circulation for an adjacent industrial parcel and noted the lot is more visible from the interstate than from the street from which it is accessed. She told the board there were no public comments submitted during the hearing and that the change does not conflict with the city’s comprehensive plan.

Following staff recommendation, Board member Kristen Levine moved to approve the variance as meeting criteria a through e; a second was recorded from Missal. The board then conducted a roll call vote with members Broomfield, Erwin, Al Levine, Kristen Levine, Missal (appearing as "Missiles" in parts of the transcript), Powery and Ally voting yes. The chair announced the motion passed.

The approval authorizes the boundary-line adjustment described in the application; no conditions, amendments or additional permits were noted on the record. The board adjourned at approximately 6:39 p.m.
