The Town of Oakland Appearance Review Board on April 7 approved amended minutes from its March 3 meeting after members debated whether a 30% fenestration requirement should apply to end caps facing both State Road 50 and the Florida Turnpike.
Vice Chair Gill raised the issue, saying the developer at the Turnpike Commerce Park had sought to reduce the code requirement from 30% fenestration to 8% and that her motion had intended a uniform treatment of end caps. "I believe that we'd like it to be throughout the whole building on all its sides," Vice Chair Gill said, adding she intended the motion to require "30% fenestration on all end caps facing the turnpike and State Road 50."
A staff member cautioned that approving minutes is not the mechanism to alter the substance of a prior quasi‑judicial decision and recommended a clarifying phrasing for the record. "Approving of minutes is not a mechanism to change the quasi judicial decision that was made when the applicant was there," the staff member said, and suggested language that would make clear the requirement was meant to "encompass any end cap that is visible from either State Road 50 or the Florida Turnpike."
Board members debated whether the minutes should state the requirement as applying to end caps "visible from either" road or explicitly require fenestration for end caps facing both corridors. Vice Chair Gill said she preferred the latter formulation to remove ambiguity: "I do not agree to changing the wording to say Route 50 or the Turnpike. I believe that we want the motion we approved to read 30% fenestration on all end caps facing both State Road 50 and the Turnpike," she said.
After discussion about process and recordkeeping, the board voted to approve the minutes with the amendments presented at the meeting. The Clerk moved to approve the minutes with the stated adjustments; a member seconded and the motion passed by voice vote.
The board’s decision preserves the record and gives members a path to submit additional written clarification later in the review process and at subsequent hearings if they wish. The matter remains subject to the town’s normal permit and quasi‑judicial review steps.
