The Box Elder City Council voted to approve preliminary plan number 240284 for the Litsky Subdivision, a phase-two proposal that staff said includes seven commercial lots and a drainage lot, subject to three conditions required before infrastructure work may begin.
Planning director Marley Patton presented the application, saying staff reviewed the submission and that the applicant plans to construct the western portion of Rhone Road as proposed. "This applicant's proposing phase 2 of the Litsky Subdivision. This is consisting of 7 commercial lots ... and a proposed drainage lot," Patton said during the presentation. Patton also noted that staff review did not change the stipulations and that engineering and council approvals remain outstanding.
The council’s motion to approve the preliminary plan includes the following conditions: design-engineering plan approval by the city engineer before infrastructure installation; city council approval of an amendment to the existing Litsky Subdivision development agreement that includes phase 2 before infrastructure installation; and final plat documents must comply with the final plat regulations in Box Elder municipal code article 36B. The motion was moved and seconded and adopted by roll call vote.
Why it matters: The approval advances commercial development in the cited subdivision and establishes a clear sequence of approvals — engineering review, a development-agreement amendment approved by council, then final plat submission — before construction of required infrastructure.
The record of the application included lot-size descriptions transcribed as "ranging in sizes from an acre to about acre and 0.5," a phrasing that the transcript left unclear; council and staff did not read precise, corrected lot-area figures into the record at the meeting. The council vote was recorded as unanimous on the motion as presented. Next steps: the applicant must secure city-engineer approval of design plans, the council must approve the amended development agreement adding phase 2, and the applicant must submit a final plat that conforms to article 36B prior to starting infrastructure work.
