Edgerton mayor calls proposed Johnson County fire-district consolidation “taxation without representation”

Roberts said he and City Administrator Beth Linn attended a Johnson County Board of County Commissioners meeting and that both local fire-district boards and the BOCC had already passed the consolidation plan. He characterized the governance structure under consideration as “taxation without representation,” arguing that the proposed model would allow BOCC members—many of whom do not live inside the consolidated district—to make decisions that affect Edgerton without local voting representation.
City Attorney Todd Luckman told the council the districts were originally formed under different statutory schemes; he said that, while the current formation appears to be legally permissible, there may be limited procedural remedies for affected parties. Luckman said he would research options including a protest petition or whether a charter ordinance could provide a remedy, but warned that available paths may be narrow.
Councilmembers asked staff to investigate alternatives and to report back. No formal action or vote was taken during the meeting.
What happens next: The City Attorney will research statutory and procedural options and report findings to the council. Residents concerned about the consolidation were informed of the possibility of a protest petition but were also told that achieving the required thresholds may be difficult.
