Cypress Avenue resident asks city to resolve disputed easement after neighbor installs gate

Connor (242 Cypress Ave) raised a property dispute during public input at the Dec. 8 Oak Hill commission meeting, saying the city’s issuance of a fence permit and a neighbor’s subsequent installation of a cattle gate left a shared access easement constrained to roughly 10 feet and created access and safety concerns.
Connor said he obtained an updated survey after obtaining a permit and that staff initially approved his fence placement based on those surveys. He said a neighbor then installed a gate that effectively reduced the opening available to the neighboring property, leaving one resident with a very tight driveway entrance. Connor said he has documentary evidence and civil counsel and asked the city to help resolve the matter.
City staff and the city attorney reviewed the situation on the record and told Connor the city will consult title records, re‑examine the permit history and speak with his title attorney. The city attorney characterized the problem as recurring around older unrecorded easements and said staff would look for a comprehensive approach to avoid similar future disputes. No immediate enforcement action was taken; staff will follow up with the resident.
