Council introduces zoning text amendment to restrict cannabis dispensaries near residences

The Montgomery County Council, sitting as the district council, introduced Zoning Text Amendment (ZTA) 25‑07 to regulate retail cannabis sales and services. Lead sponsors Council Members Albanese and Katz said state law (SB 215) gives local jurisdictions discretion to set a residential buffer; the draft amendment would use a 100‑foot buffer from residences.
Council Member Albanese, speaking to the purpose of the ZTA, said local enabling language in SB 215 allows jurisdictions to balance proximity concerns with dispensary access and recommended 100 feet as a reasonable boundary that both protects residences and preserves business viability. He thanked the Kensington mayor and Delegate Jared Solomon for engagement during the policy’s development and noted a public hearing is scheduled for June 17, 2025 at 1:30 p.m.
The introduction does not represent a final decision; the ZTA will return for public hearing and further council deliberation as part of the district council process.
