The Fulshear Development Corporation on Feb. 23 discussed a City Council decision to ask voters to approve rerouting part of the corporation's Type A sales-tax allocation into the city general fund to support police salary increases. Legal counsel told board members that, during board meetings, they should avoid taking or announcing a collective position for or against ballot items and limit remarks to factual impacts or consequences.
"During these meetings, the board, all board members should stay away from taking a particular stands for or against ballot items," legal counsel said, adding that members may discuss practical consequences or impacts but should not suggest they represent the board's position. Staff repeated that the exact ballot wording and supporting materials are available in the council agenda packet and on fulsheartexas.gov.
Staff said City Council heard a presentation from Brian White on Feb. 3 about the potential impacts of reallocating sales-tax revenue and subsequently voted to place a question on the ballot asking voters to approve rerouting part of the Type A allocation into the city's general fund. Staff directed board members to the council packet for the precise language and noted they can email the packet link to members.
Board members discussed the practical implications of the reallocation on EDC-funded projects and how the EDC tracks jobs tied to infrastructure investments. One member urged tracking direct jobs that result from executed contracts while other members noted it is difficult to quantify jobs that are "possible" or "probable" until agreements are in place.
No formal action on the ballot item was taken by the EDC at the meeting; staff emphasized the board's role is to document potential impacts and stay ready to answer factual questions. The council packet contains the formal ballot language and additional materials that staff said members should review before discussing the issue outside of a posted meeting.
