ZBA to inspect Pollet Lane property after shed-legalization request

The Town of Wappinger Zoning Board of Appeals on July 21 heard from Anna Marie Cronizer, the real estate agent representing owner Theodore Molinari, about a request to legalize a 12-by-18 shed at 40 Pollet Lane.
Cronizer said a new survey showed the shed is 25.1 feet from the side-yard line where 40 feet is required, creating a dimensional variance request of 14.9 feet to obtain a certificate of occupancy needed for an impending sale. Board staff noted the property is effectively on two streets (a corner condition), which can create two front yards for zoning purposes and sometimes requires an additional variance to clarify which side is a front or rear yard; the board said adding the second variance in the paperwork would not delay closing.
The board scheduled a site visit for Aug. 22 at about 9:30–9:45 a.m. to stake the property line and visualize the setback; members suggested the applicant mark stakes or otherwise make the relevant dimensions visible prior to the inspection.
The agent said the owner could not attend the hearing and asked that the process not delay closing; board members said the added wording is a procedural clarification and would not lengthen the timeline. The board did not vote on the variance on July 21 and will consider the matter after the site visit and any required notices are completed.
