Zoning board grants Wappinger homeowner variances for pool and three sheds

The Town of Wappinger Zoning Board of Appeals on July 21 granted homeowner Jeffrey Ruffino the variances he sought to install a 16-by-32 in-ground pool and to keep three sheds at 10 Carroll Drive.
Ruffino told the board he plans to remove the existing pool and deck and relocate one of the sheds. "Variance for my pool," he said, and described the sheds as storage for a large family. Chair said the application requests a 20-foot rear-yard variance where 40 feet is required and a side-yard variance leaving 6.2 feet where 10 feet is required for one shed.
Committee member 3 moved to grant the three variances, reading findings that the requested variances would not produce an undesirable neighborhood change, would not substantially detriment nearby properties, and that no feasible alternative exists to achieve the applicant’s stated need. The board noted the requested variances are "substantial" because three accessory structures exceed the two allowed in a single-family district, but members added a condition: if any of the three sheds is later damaged or removed, any replacement would have to comply with current zoning (two structures allowed) and would require reapplication.
Chair seconded the motion and called a roll call; the four members present voted yes and the motion carried (the board noted one member was absent due to a car accident on Route 684). The chair told Ruffino the building department would contact him within a few days to explain next steps for permits.
The board’s decision includes the following specific approvals and limits: a 20-foot rear-yard variance for the pool, a side-yard variance that legalizes the existing shed at approximately 6.2 feet from the side lot line, and temporary recognition of three accessory structures on the parcel; the latter allowance is conditioned so that replacement of a structure after damage would require compliance with current code. The building department will provide permit instructions to the applicant.
The board moved on to the next agenda items after the vote.
