State zoning changes take effect July 1; Boxborough planner to audit town bylaw

Boxborough’s planning staff told the Planning Board on July 20 that changes to the state zoning law took effect July 1, 2026, and that the town’s zoning bylaw likely contains provisions that are now out of compliance.

Alec told members he had circulated advisories from special land-use counsel (Mead Tallerman and Costa) and KP Law that identify changes affecting nonconformities, notice requirements and the town’s prior prohibition on use variances. He said the law applies retroactively and that he will perform a full diagnostic of the bylaw, identify deficiencies, and issue recommendations early next week so board members have time to review before deciding whether local changes should appear on a fall warrant.

Board member Mark White warned that the state changes represent a significant shift in local authority, calling them "a blow against home rule" and urging caution and public engagement before rushing local amendments. Alec recommended monitoring how the Zoning Board of Appeals interprets the new provisions and holding an Aug. 31 placeholder meeting if needed to discuss staff recommendations.

Staff emphasized this is an ongoing issue and that additional statewide changes could follow; the board agreed staff should return with a prioritized list of bylaw sections requiring attention and proposed language if changes are recommended for fall town meeting.
