The Saco Planning Board voted unanimously to approve the site plan application for Park North (991 Portland Road), a multi‑phase, five‑building mixed‑use development, while members also debated public concerns about whether the Park North contract zone retains "vested" status following prior City Council action.
Matthew Orr, civil engineer with Sebago Technics, presented clarifications on phasing, utilities and sewer capacity for phase 1. He told the board the applicant had supplied a phasing plan and had secured confirmation from the sewer department that phase 1 capacity is adequate. "We've supplied a phasing plan and confirmed sewer capacity for phase 1," Orr said.
During the reopened public hearing, Inga Brown, a Ward 1 resident, questioned the legal basis for treating Park North as a vested contract zone after the council repealed pre‑2021 contract zones. Brown urged the board to seek judicial clarity on vested rights and said the financial‑capacity letter in the packet from Androscoggin Bank was insufficient to show committed financing. "The Park North contract zone is repealed," Brown said. "This application before you this evening is an initial site plan. This is not an amendment to an existing site plan. This is a brand new site plan. You cannot amend a contract zone. You cannot move forward with a brand new site plan application."
Staff and several board members cited a City Council‑adopted standard operating procedure and a council order that, they said, recognizes three vested contract zones — including Park North — and advised the board to review the application under the established framework. City Planner Charles Tillman told the board the SOP, adopted by council, vests the Park North contract zone and provides legal guidance. Council liaison Mae Johnson said she was not speaking for the city solicitor but noted council had taken action that sets a path for board review.
The board discussed whether to keep the hearing open for further legal review. Several members said the council's order and the SOP underpinned staff's recommendation to proceed; others recommended legal counsel if there remained doubt. After debate, the board adopted the findings of fact and the conditions of approval and then approved the site plan application for Park North, each by unanimous votes. Conditions include the standard requirement for a financial guarantee (a city letter‑of‑credit at 150% of estimated public improvement costs) before any site work begins.
Applicants said they will provide the detailed cost and financial guarantee before preconstruction; a developer representative noted these letters are standard early application documents and that a formal letter of credit is required before construction. The board scheduled no further action on the item, and staff reminded members of an upcoming site walk and necessary follow‑up steps.
