The El Dorado City Commission on May 4 adopted a resolution directing city policy to comply with House Substitute for Senate Bill 244, a state law that requires designation of single-gender multiple-occupancy private spaces in public buildings.
City staff told the commission the law became effective Feb. 24 and that it applies to restrooms and other multiple-occupancy private spaces in city-owned or -leased buildings, including city hall and recreation facilities. The manager said the city attorney and neighboring municipalities were consulted while drafting the policy and that the policy was designed both to meet the law’s requirements and to define complaint-handling procedures.
Staff also said the statute charges the attorney general with investigating complaints against government entities and noted potential civil penalties of $25,000 for a first violation and $125,000 for subsequent violations. After a motion, second and brief discussion, the commission voted to adopt the policy.
The adopted policy directs city staff to post or otherwise designate applicable multi-occupancy private spaces and to follow the complaint process described in the policy. The commission recorded the vote as carried on a voice vote.
