Cudahy council approves Packard Avenue sanitary-lateral replacement after residents raise damage concerns

DPW Director Lange outlined the Packard Avenue project, described as lateral replacement between Plankinton Avenue and Cudahy Avenue. The mayor opened the hearing at 7:21 P.M., and members of the public spoke about potential and observed impacts to private property. Residents who addressed the council included Joseph Zsebe (4617 S. Packard Ave.) and Rebecca Hiracheta (4609 S. Packard Ave.) regarding damages; Robert Escamalia (4550 S. Nicholson Ave.) regarding assessments; Brian Mollberg (5033 S. Lake Dr.) regarding the process; Greg Loferski (2533 E. Donald Ave.) asking about corrective action; and Karen Betz (3622 E. Whittaker) who also spoke during the hearing.
Following the public hearing, the council considered Resolution No. 7049, "Final Resolution for the Replacement of Sanitary Sewer Laterals on Packard Avenue Between Plankinton Ave. and Cudahy Avenue and Declaring Intent to Exercise Special Powers Under Section 66.0703, Wisconsin Statutes." MOTION BY ALD. LITKOWIEC, SECOND BY ALD. HOLLENBECK to approve Resolution No. 7049 and to investigate damage-to-property claims. The roll call vote carried unanimously.
City Attorney Eberhardy, who had left the meeting prior to the hearing at 7:20 P.M., returned after the council approved the resolution. The council did not set an exact assessment amount in the motion; staff were directed to pursue investigation of reported damages and proceed with the special-assessment process described in the statute.
The approved resolution authorizes replacement work and signals the city’s intent to use special-assessment authority under state law. The council’s next procedural steps are for staff to document reported damage claims and report back with findings and cost/assessment estimates.
