House committee approves three Idaho Department of Lands rule dockets and clarifies easement appraisal practice

Andrew Smyth, Bureau Chief at IDL, presented Docket No. 20-0302-2401 on rules governing mined land reclamation and described the agency’s rule-making authority and process for collecting public comment. Will Tiedemann of the Idaho Conservation League spoke in neutral support but raised concerns about a five-year interval between updates and noted potential inconsistencies between the Code and the proposed Administrative Rules. Rep. Raymond moved to approve the docket; the motion carried by voice vote.
Marde Mensinger, Program Manager at IDL, presented Docket No. 20-0304-2401 regarding regulation of beds, waters and airspace over navigable lakes; Rep. Raybould moved to approve and the motion carried by voice vote.
Lawson Tate, Program Manager at IDL, presented Docket No. 20-0308-2501 concerning easements on state-owned lands. In response to committee questions about how appraisal charges are set, Tate said charges are “to be determined” depending on the circumstance; if an internal appraiser is not available for a remote or time-sensitive easement, IDL contracts qualified appraisers from community listings and does not maintain a preferred appraiser list. Rep. Raybould moved to approve the docket; the motion carried by voice vote.
All three dockets were approved by voice vote; committee minutes do not record roll-call tallies. The committee returned the gavel to Chairman Mendive and adjourned at 2:06 p.m.
