Christopher Capone, a wetlands consultant for Equity Real Estate, presented an abbreviated notice of resource area delineation for a 26-acre property at 1212 Main Street and asked the commission to confirm the delineation. Capone described two bordering vegetated wetlands, an unnamed perennial stream, and buffer zones; multiple commissioners who visited the site supported the delineation and the commission voted to accept the plan dated 01/06/2026 as presented.
On another agenda item, David Devignon of Schneider, Devignon and Leoni presented a Notice of Intent for a newly created subdivision lot on Angelo Drive where applicants Luke Hebert and Jessica Brown propose a single-family house, an in-ground pool, a well, septic, driveway and utilities partially within the 100-foot buffer zone. Devignon outlined setbacks, erosion-control measures and a roof-runoff recharge system. The commission attached special conditions to the Order of Conditions including an on-site erosion-control inspection with the contractor within five days prior to construction, a prohibition on stockpiling and refueling in the buffer zone, a requirement that a certificate of compliance request be filed within 18 months of an occupancy permit, and a $250 fine for noncompliance; the commission voted to issue the Order of Conditions as presented.
The after-the-fact Notice of Intent from Doug and Lauren Lemieux for work at 35 Hathaway Road — a drainage ditch constructed in a wetland resource area — was continued at the applicants' request to the August 12 meeting to allow further review and documentation.
What happens next: The Angelo Drive applicants must meet the special conditions and request a certificate of compliance at the appropriate time; the Lemieux matter will be continued to Aug. 12 for additional review.
