Krebs planning commission recommends 150-foot Allsup’s sign, withholds permit recommendation until stamped survey is filed

On Aug. 6, 2024, the Krebs Planning & Zoning Commission voted to recommend a 150-foot sign for an Allsup’s convenience store and to withhold its recommendation on a 30-by-50-foot shop permit until the applicant provides a stamped legal survey showing setbacks. The board also voted not to recommend vacating Fox Avenue and Spruce Street.
Michael Bradley Everett, representing Texas Republic Signs on behalf of Allsup’s, told commissioners the company had obtained FAA clearance and completed a crane survey intended to ensure the sign’s placement would safely direct truckers and patrons off the highway. "We did a crane survey to see what type of sign we need to get truckers and patrons off the road safely coming for gas," Everett said. The commission voted unanimously to recommend the 150-foot sign.
The board declined to recommend a building permit for a 30 x 50 shop planned at 105 SW 1st after Commissioner Richard Cotton pressed for a stamped legal survey that shows the exact location of the improvements and confirms compliance with setback requirements. Applicant Kyle Bess said he was unaware of the survey requirement until the previous morning. "If I got a survey next week would I have to wait till September to come back?" Bess asked; Chairman Mark Moy replied that if the applicant files the stamped survey with the city clerk the commission might call a special meeting. Cotton moved to not recommend the permit until a legal survey with the surveyor’s seal is provided; the motion passed with votes from DeFrange, Cotton, Garigin and Moy.
On two separate agenda items, the commission considered petitions to vacate streets in Block 135. Richard Cotton moved to not recommend vacating Fox Avenue; Cindy Cooper, the city clerk, said an ordinance to close the street dated to 1997–98 but was never filed with the county. The commission voted unanimously to not recommend vacating Fox Avenue. The board also voted unanimously to not recommend vacating Spruce Street, following a motion by Cotton.
All motions on these agenda items passed by unanimous vote of commissioners present. The commission did not set final city policy; its recommendations will go to the Krebs City Council for final action.
