On Feb. 9, 2026 the Town of Proctor Selectboard reviewed a request to reconnect 109 Deere Lane to town water and, following an executive session, directed Town Manager Judy Frazier to have the Town Attorney write a letter denying the connection.
The request was presented to the Board of Water Commissioners portion of the meeting by Robb Spensley, who said he was “representing Hilary Lambert” and that the property had been disconnected from Proctor water by owner request in 2016. Spensley provided maps and handouts and said the property is currently served by a well on adjacent land; he said the owner seeks reconnection and plans to sell a portion of the property.
Town Manager Judy Frazier and Selectboard members asked clarifying questions about state Wastewater Systems and Potable Water Supply permits needed to bring the property into compliance. No formal vote on the reconnection appears in the public minutes; after moving into executive session under the attorney–client exemption (1 V.S.A., Section 313(a)(1)(F)), the Selectboard reconvened and by consensus directed the Town Manager to have the Town Attorney send a denial letter to Hilary Lambert and Robb Spensley.
Selectboard procedure: the board adjourned to convene as the Board of Water Commissioners at 6:08 p.m. to hear the matter and later returned to the Selectboard; the record shows the denial direction was issued by consensus after executive session. Bruce Baccei had introduced the motion finding that premature public disclosure would place the town at a disadvantage for attorney–client communications.
What this means: the denial stops a town-water reconnection process for 109 Deere Lane; the minutes note the property’s prior disconnection and the applicants’ stated intent to sell a portion of the parcel. The minutes do not explain the legal or technical grounds for denial beyond the executive-session discussion, and they do not record a roll-call vote on the directive. The Town Attorney’s letter and any appeal or subsequent administrative steps were not recorded in the minutes provided.
Next steps: the town manager was directed to send the denial letter to the owner’s representative. Any further appeals, applications, or permit submissions would be handled through the town’s standard permitting and appeals processes and documented in later meeting minutes.
